Terms & Conditions

  1. Application to participate in the Nintendo Labo Workshop taking place in London between Wednesday 14 February 2018 and Saturday 16 February 2018 inclusive (the “Workshop”) is open to residents of the UK and Ireland, excluding employees and the immediate families of the Promoter, its agents or anyone professionally connected with the Workshop. Applicants must be aged 18 years or over.
  2. By submitting the registration form, applicants agree to be bound by these terms and conditions and are representing that they have consent from all individuals named in the registration form, or the parents/guardians for those individuals aged under 18, to apply to participate in the Workshop in accordance with these terms and conditions.
  3. Applications may be submitted for up to two adults (aged 18 years or over) accompanying up to 4 children aged between 7 and 15 years old. A Permission Form will be required to be signed by the parents/guardian of any children attending without their parents/guardian.
  4. Applications and participation in the Workshop is free of charge. Travel to and from the Workshop and any ancillary costs associated with attending the Workshop is the responsibility of and must be borne by the applicant. To apply to participate in the Workshop, applicants will require access to the internet and should submit a completed registration form by no later than 23:59 on Wednesday 31 January 2018. The Promoter cannot guarantee uninterrupted or secure access to the application route. Entry is strictly limited to one application per person. Only the first application will be accepted. Subsequent applications will be disregarded.
  5. Successful applicants will be notified by Tuesday 6 February 2018 using either the email address or phone number provided in the registration form. Successful applicants and any individuals named in their application must confirm their participation in the Workshop by returning a completed Permission Form to the Promoter by Monday 12 February 2018. If the Promoter does not receive the completed Permission Form for each individual attending with and including the applicant by this date, the Promoter may allocate the place at the Workshop to a substitute applicant. The Promoter will endeavour to offer successful applicants one of the sessions requested in their registration form however, due to the number of applications, this may not be possible in every case and an alternative session may be offered.
  6. Participation at the Workshop is non-transferable and is strictly limited to the session time and date for which a successful applicant has been selected.
  7. All applications must be made directly by the person submitting the registration form. Applications made online using methods generated by a script, macro or the use of automated devices will be void. No responsibility can be accepted for entries lost, delayed or corrupted, or due to computer error in transit.
  8. The Promoter reserves the right to verify all applications, successful applicants and individuals named in successful applications, including, but not limited to, age and eligibility to enter, and to remove the entitlement to participate in the Workshop, where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotions entry requirements.
  9. The Promoter reserves the right to withdraw, suspend or amend the Workshop and the application process for it without prior notice in the Workshop of any unforeseen circumstances outside its reasonable control hindering the orderly procedure of the Workshop or the application process, including, without limitation, breakdown of hardware or software, unauthorised intervention of third parties as well as mechanical, technical or legal problems outside the Promoter’s reasonable control and influence.
  10. Applicants’ personal data and that belonging to the individuals named in any application (“Data”) will be collected, stored and processed strictly for the purposes of administering and assessing the application process and Workshop. Data will only be used to the extent and for the time necessary to conduct the Workshop including the application process. In particular, the Promoter will not (i) transfer Data to any third party other than those engaged to facilitate the Workshop, including the application process, on behalf of the Promoter and who have committed to the processing of data according to the principles of this privacy statement or (ii) use/process Data for promotion or any other purposes. Personal data belonging to unsuccessful applicants and those individuals named in any unsuccessful application will be deleted immediately after all participants have been selected. All personal data belonging to successful applicants and those individuals named in any successful application will be deleted immediately after the Workshop has been conducted save to the extent that the Promoter is required or permitted to retain it by law.
  11. Rights of use:
    a) Each participant in the Event agrees to the exclusive, unlimited, worldwide and royalty-free use of all pictures, audio- and video-recordings of that person made by or on behalf of Nintendo during the Event (the “Material”) by the Promoter for any purpose, including, but not limited to, the reproduction, distribution, publication and making available of the Material in any form and any and all media (TV, radio, cinema, internet, print media, recordings etc.). The Material may be used for advertisement or promotional purposes and public relation matters of any kind in connection with the Event, the Nintendo Switch console and software. The Material may be adapted, changed or modified in any way (e.g. colouring, reducing, multiplying, making excerpts, etc.).

    b) The Promoter may transfer, assign or sublicense the rights granted under this section (wholly or in part) without any restrictions to third parties, especially, but not limited to, its affiliates.

    c) The Promoter ensures to not make the participating family member appear in a bad light but is otherwise free in the use of the Material. Each participant in the Event waives his/her right to inspect or approve the final product, the website, the promotional copy, the script or print material, etc. that results from the use of the Material.
  12. The Promoter and its associated companies and agents excludes all responsibility for and all liabilities arising from any postponement, cancellation, delay or changes to the application process or Workshop, or arising from the Workshop itself, to the extent permitted by English law.
  13. These terms and conditions are governed by and shall be construed in accordance with English law.
